Patent Application

In the United States, this is a document submitted to the United States Patent & Trademark Office (USPTO) to apply for a patent in the name of the inventor(s).  A patent grants the inventor the right to exclude others from practicing the invention; that is, from making, using, selling or offering for sale, or importing the invention into the United States.

While the application may be filed by the inventor himself/herself who has knowledge of the process and the requirements, it should be filed by a patent attorney or patent agent, either of which must be registered to practice before the USPTO. 

Other than the inventor, a patent attorney or a patent agent, no one can file a patent application for another person without violating federal law.
